Cybersquatting: Extortion in digital world
Cybersquatting also known as Domain squatting is registering, trafficking in an internet domain with bad intentions intent to profit from the goodwill of a trademark belonging to someone else. The work is derived from “Squatting”, which is an act of occupying an abandoned or unoccupied space or building that the squatter does not own, rent, or otherwise have permission to access/ use. Technical strategies for Cybersquatting is mainly “Typo squatting”.
Impact of Cybersquatting on Social Media and banking sectors
With the rising of social media websites such as Facebook and Twitter, a new form of cybersquatting involves registering trademarks protected brands or names of public figures on popular social media websites.
Some notable cases which may help you to understand the following technical concept. Starting with the first case which includes updates from bollywood side where on last month a man from Florida bought rights to a domain in pope benedict XVI’s name sending the Vatican into a flap. The issue was resolved when he donated the rights to a charity. Cybersquatting isn’t really a big issue in India because the vanity of stars having their official website haven’t really taken off. Most Bollywood film stars are unaware that their names have been hijacked or that sites in their names can be potentially misused for pornographic content. Even Big Stars like Salman Khan, Kareena Kapoor, Ajay Devgan and Priyanka Chopra do not own their domain names. If you try say amitabhbachhan.com, or hritikroshan.com, you will find that they have already been bought by someone else. Who would say that www.liveindia.com is Priyanka Chopra’s site or www.fisheyenetwork.com is Pooja Bhatt’s. While moving on to other scenario of bank it has been noticed that an Australian entity (Active Pvt. Ltd), floated a website on domain name, www.sbicards.com, even ‘tricked’ financial big time-entities like Chase Manhattan into advertising on the site. The SBI ARM, which had already registered the domain name with Fabulous.com Pvt. Ltd. Lodged a complaint on March 16 at the WIPO GEVEVA (World Intellectual Property Organization). The WIPO Administrative panel found that Australian Entities website could have attracted potential attention from the public because of its affiliation with SBI cards products/services. At the same time it created a risk of confusion with the product’s/service’s and trademark as to the source, sponsorship, affiliation or endorsement of its website. Hence, at last we conclude that people must have a basic knowledge of using internet websites else It may result with the case of cyber fraud or cybersquatting and believe us that no one could easily claim for any kind of damages or compensation for their products or services because in these such cases jurisdictional clauses may affect since there is no such policies between countries that they could easily grab the cybercriminal. It may also leads to the financial frauds by attempting phishing attacks.
